Key 2025 Legal Updates for Property Managers
Security Deposit Documentation (AB 2801): Starting April 1, 2025, landlords must take and provide photographs of the rental unit at three key stages: before or at the start of tenancy, after the tenant vacates but before any repairs, and after any repairs or cleaning are completed. These photos, along with a written explanation of any deductions, must be shared with the departing tenant. California Apartment Association
Positive Rental Payment Reporting: As of April 1, 2025, landlords are required to offer tenants the option to report positive rental payment history to at least one nationwide consumer reporting agency. This offer must be made at the time of lease signing and at least once annually thereafter. California Apartment Association
Move-In/Move-Out Inspections: Effective April 1, 2025, landlords must conduct and document move-in and move-out inspections, providing tenants with a written statement of the condition of the unit and any deductions from the security deposit. California Apartment Association
Fire Safety Disclosures: For homes built before 2010 in wildfire-prone areas, sellers are now required to disclose implemented wildfire protection measures and provide a list of recommended low-cost mitigations. This aims to promote property retrofitting to reduce wildfire vulnerability.
